The following is a letter that was sent to the neighborhood in March. The time for the suite to be brought up by the courts will be soon. If you have not joined us in the suite to be allowed to change the covenants and wish to do so, please give me a call so that I can come by and get you to sign the joiner form.

Dear Neighbors:
Earlier this month we informed you the Millcreek Place Board of Governors would be asking the Chancery Court of Rankin County to reform the covenants affecting our neighborhood. The only relief the Board of Governors would ask for is to allow the residents the power to amend the covenants. We are not asking for substantive changes to our covenants, simply the ability to amend based upon a majority vote of the residents. The draft Complaint attached herewith is provided to you so that you can see the direction of the Board of Governors is taking. We want you to have as much say and input as you desire during this process. We encourage you to review the draft Complaint and contact either the members of the Board of Governors, or the attorney representing Millcreek Place, with your questions, suggestions, corrections, or objections. We have not filed this Complaint, and will not until after we have received input from you, the homeowners.
Once the comment period is over which ends on April 15, 2012, the Board will file the finalized Complaint. At that time, we will ask all homeowners of Millcreek Place to sign a document agreeing with the relief sought. The more joiners we obtain the more expedient we can be in obtaining relief. Well past time for updating covenants. Thanks to the homeowners who have taken this task on.
ReplyDeleteWe live in a nice neighborhood and in the time I have lived here I've not experienced nor noticed any extreme activity or situation that I feel would significantly affect the value of my home. While I respect that the board would like to update the covenants, I can't help but point out that it can be for no other reason than to make their bite as big as their bark. Like many, I want less taxes, less regulation, less government, less paperwork and so the list goes on. This too I want in my neighborhood.

ReplyDeleteIt is apparent that neither of you have taken time to read the existing covenants. Also it appears that neither of you are aware of your surroundings and what is happening in the area around us. The issue that this is addressing the the fact that we have three sets of covenants for the subdivision none of which can be updated even if we wanted to make a change. All this suite is going to accomplish is allow us to make a change if we see fit.
